Sales Tax Case Oral Arguments Today at U.S. Supreme Court

Today is the day that both sides in South Dakota v. Wayfair, Inc. will argue their case at the U.S. Supreme Court.

The question presented to the high court is:

“Should this Court abrogate Quill’s sales-tax-only, physical-presence requirement?”

There have been over 60 briefs filed in this case, some neutral, some favoring the states while others favoring online retailers.

We recently posted excerpts from the Online Merchants Guild brief, a new association that represents small business online retailers, that highlighted the abuses by some states on existing laws and the negative impact overturning Quill will have on small businesses that all of a sudden will have to deal with thousands of tax jurisdictions.

The U.S. Supreme Court does not allow cameras but audio recordings and an official transcript should be available by the end of day.
